ASKFLY TERMS OF SERVICE

IMPORTANT NOTICE: THESE TERMS CONTAIN PROVISIONS THAT LIMIT ASKFLY'S LIABILITY, DISCLAIM WARRANTIES, AND MAY REQUIRE INDIVIDUAL ARBITRATION OF CERTAIN DISPUTES. PLEASE READ CAREFULLY.

By accessing or using AskFly's website, mobile application, platform, tools, content, or related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use AskFly.

Acceptance of Terms

These Terms form a binding legal agreement between you and AskFly Inc. ("AskFly," "we," "us," or "our"). "You" means any person or entity accessing or using AskFly.

By creating an account, accessing, browsing, or using AskFly, you confirm that you have read and understood these Terms; agree to be bound by them; are legally able to enter into a binding agreement; and will comply with all applicable laws and regulations in connection with your use of AskFly.

If you use AskFly on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

About AskFly

AskFly is a travel intelligence platform designed to help users access travel-related information, planning support, alerts, checklists, document organization tools, and other travel guidance tools.

AskFly may provide destination and travel information; visa and entry requirement summaries; baggage or airline policy guidance; travel checklists and reminders; travel-related AI answers and insights; document organization or storage tools; subscription-based premium features; and links to third-party providers, travel partners, or affiliate services.

AskFly is a technology platform only. Unless expressly stated otherwise, AskFly does not itself provide transportation, hotel accommodations, insurance, visa issuance, legal services, immigration representation, travel agency services, or other travel supplier services.

No Travel Agency, Legal, Immigration, Medical, or Professional Advice

AskFly provides general informational and educational content only.

AskFly is not a travel agency, tour operator, airline, hotel, carrier, transport provider, border authority, law firm, immigration consultancy, visa processing authority, medical provider, tax advisor, financial advisor, or professional advisor.

Nothing on AskFly constitutes legal advice, immigration advice, customs or border clearance advice, medical advice, tax advice, financial advice, or professional certification of eligibility to travel.

Any information provided by AskFly, including AI-generated content, travel summaries, visa guidance, document prompts, baggage information, readiness scores, alerts, or travel checklists, is for general informational purposes only and is not a substitute for consulting official government, embassy, consular, airline, airport, customs, health, insurance, or legal sources.

You remain solely responsible for verifying all critical travel information directly with the relevant official sources before traveling.

Eligibility and Account Registration

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an AskFly account or purchase a paid plan, unless applicable law permits otherwise with parental or guardian consent.

You agree to provide accurate, current, and complete information during registration and to keep your account information updated. We may refuse access to the Platform or suspend accounts where information is inaccurate, misleading, fraudulent, or incomplete.

User Accounts and Account Security

You are responsible for maintaining the confidentiality of your login credentials, all activity occurring under your account, and notifying us promptly of any unauthorized use or suspected breach.

You may not share your account with others, transfer your account without our written approval, impersonate another person or entity, or create an account using false or misleading identity information.

AskFly is not liable for losses arising from unauthorized use of your account caused by your failure to safeguard your credentials.

Platform Features and Services

AskFly may offer free and paid features, including AI travel Q&A, personalized travel insights, document or trip organization tools, alerts and notifications, premium travel intelligence features, affiliate or partner links, and future paid subscriptions and plan tiers.

We may add, remove, modify, limit, suspend, or discontinue features at any time, with or without notice, subject to applicable law. Some features may be available only in certain countries, languages, subscription plans, or device types.

AI-Generated and Informational Content

AskFly may use artificial intelligence, automated systems, data models, third-party APIs, or machine-learning tools to generate responses, recommendations, summaries, alerts, readiness scores, or travel guidance.

You understand and agree that AI-generated content may be incomplete, outdated, inaccurate, or not suitable for your specific circumstances. AskFly does not guarantee that any answer, recommendation, checklist, alert, readiness score, or prompt is error-free. Travel rules, visa requirements, airline policies, baggage rules, border enforcement, health requirements, and entry procedures can change rapidly and without notice.

AI outputs should always be independently verified before you rely on them. AskFly may display confidence indicators, reminders, warnings, or prompts encouraging independent verification. These do not reduce your responsibility to verify critical travel information.

User-Provided Information and Accuracy

AskFly may rely on information you provide, including nationality, passport information, residency, travel dates, destinations, transit points, airline information, baggage details, pet travel details, uploaded documents, and preferences.

You are solely responsible for ensuring that all information you submit to AskFly is accurate, complete, current, and not misleading. AskFly is not responsible for errors, omissions, incorrect outputs, missed alerts, or travel consequences resulting from inaccurate, incomplete, outdated, or misleading information submitted by you.

Travel Requirements, Visa, Entry, and Documentation Responsibility

You are solely responsible for ensuring that you satisfy all travel requirements applicable to your trip, including passport validity, visas, transit visas, residence permits, entry permits, return or onward travel requirements, customs declarations, health documentation, vaccination requirements, pet travel rules, baggage compliance, airline check-in and boarding requirements, and destination-specific laws and restrictions.

AskFly does not guarantee that you are eligible to enter any country; that you will be allowed to board a flight; that any visa or authorization is available, sufficient, or properly issued; that any airline, border official, immigration officer, customs official, or other authority will accept documentation referenced on the Platform; or that all information shown on the Platform is current at the time of travel.

Failure to verify travel requirements directly with official sources may result in denied boarding, missed flights, cancellation, fines, deportation, quarantine, confiscation, or other losses for which AskFly is not responsible.

Travel Readiness Scores and Similar Indicators

AskFly may provide a Travel Readiness Score, Travel Intelligence Score, checklist status, risk indicator, confidence indicator, or similar metric. These scores and indicators are provided solely as informational tools based on available information and user inputs.

No score, indicator, checklist, warning, or status label constitutes a guarantee of travel eligibility, admission, boarding, documentation compliance, visa sufficiency, health compliance, border clearance, pet acceptance, or travel success. You remain solely responsible for verifying all requirements with official sources.

Travel Alerts and Notifications

AskFly may provide travel alerts, reminders, notifications, or warnings relating to travel requirements, weather, strikes, airline issues, destination events, policy updates, or other travel-related information.

Travel alerts are provided on a best-efforts basis. AskFly does not guarantee the delivery, timing, accuracy, completeness, relevance, or availability of any alert or notification. AskFly does not guarantee that it will detect or notify you of all travel disruptions, entry changes, visa changes, cancellations, strikes, safety issues, or other events.

You remain responsible for independently monitoring airlines, airports, governments, embassies, consulates, insurers, travel suppliers, and other official sources.

Document Vault and Uploaded Documents

AskFly may offer document upload, organization, reminder, or storage features for travel-related documents such as passports, visas, travel authorizations, vaccination records, pet documents, itineraries, booking confirmations, or other files.

AskFly is not a document backup service, government document repository, identity verification authority, or official records service. You remain solely responsible for keeping original documents, maintaining your own backup copies, verifying document accuracy and validity, and ensuring that you have access to required documents when traveling.

AskFly does not guarantee permanent availability, retrieval, preservation, completeness, accuracy, readability, or acceptance of any uploaded or stored document. Loss of access to uploaded documents, service interruptions, synchronization issues, file corruption, or deletion shall not create liability for AskFly to the maximum extent permitted by law.

You should not upload highly sensitive or unnecessary information unless clearly required for a feature and only after reviewing our Privacy Policy.

Pet Travel Information

AskFly may provide information or tools relating to pet travel, including airline pet policies, in-cabin or checked pet rules, breed or weight restrictions, vaccination requirements, health documents, import rules, and destination-specific requirements.

Pet travel requirements vary by airline, country, airport, carrier, animal type, breed, weight, health status, routing, season, aircraft, and regulatory changes. AskFly does not guarantee acceptance of any animal for travel or entry into any country. You remain solely responsible for verifying all pet travel requirements directly with airlines, veterinarians, government agencies, and relevant authorities.

Beta Program, Early Access, Testers, and First 100 Users

AskFly may provide access to beta, pre-release, pilot, early access, founding user, tester, or First 100 User programs. These programs may involve unfinished, experimental, limited, or evolving features.

Beta and early access features may be incomplete, unstable, inaccurate, unavailable, or subject to bugs. Features, designs, pricing, functionality, workflows, data structures, and user experiences may change or be removed at any time without notice. Data entered into beta features may be modified, deleted, reset, or unavailable.

Beta and early access features are provided on an "as is" and "as available" basis, without warranties of any kind. By participating, you acknowledge and accept the risks associated with testing unfinished software and agree not to rely on beta outputs for critical travel decisions without independent verification.

Early Access Confidentiality and Non-Disclosure

If you participate in AskFly's beta program, early access program, tester program, founding user program, First 100 User program, or any similar pre-launch or limited-access initiative, you may receive access to non-public information about AskFly.

You agree that non-public AskFly information is confidential and may include unreleased features, designs, screenshots, user interfaces, workflows, pricing tests, subscription structures, product roadmaps, technical information, AI outputs, prompts, marketing concepts, business plans, partner discussions, feedback requests, and other information not publicly released by AskFly.

Unless AskFly gives prior written consent, you may not publicly disclose, publish, post, distribute, record, screenshot for publication, copy, share, reverse engineer, or otherwise make available any confidential AskFly information. This includes posting screenshots or recordings on social media, sending access to third parties, discussing unreleased features publicly, or using AskFly's confidential information to build or assist a competing product.

This confidentiality obligation does not prevent you from providing feedback directly to AskFly, discussing your own general user experience without revealing confidential details, or disclosing information that becomes public through no fault of your own. AskFly may revoke access immediately for any violation and may seek injunctive relief, damages, or other remedies available under law.

Third-Party Providers, Affiliates, and External Booking Services

AskFly may contain links to or integrations with third-party providers such as airlines, hotels, booking engines, insurance providers, visa services, affiliates, API providers, external travel tools, government websites, or informational websites. AskFly may receive affiliate commissions or referral revenue when you click or purchase through certain links.

Third-party services are not controlled by AskFly. We do not guarantee availability, pricing, accuracy, service quality, booking fulfillment, refund eligibility, supplier performance, or continued operation of third-party services.

Any transaction you make with a third party is solely between you and that third party and is subject to that third party's own terms, conditions, and policies. AskFly is not responsible for cancellations, schedule changes, supplier defaults, bankruptcies, overbookings, pricing errors, denied refunds, or any losses arising from third-party products or services.

Subscription Plans, Fees, Billing, and Renewals

AskFly may offer free and paid subscription plans, including monthly, annual, lifetime, trial, promotional, or other recurring or one-time plans.

By subscribing to a paid plan, you authorize AskFly or its payment processor to charge your payment method for all applicable fees and taxes. Subscriptions may automatically renew unless cancelled before renewal. Pricing, features, trial periods, and plan structures may change on a going-forward basis with notice where required by law.

You are responsible for keeping your payment information current and valid. If a payment fails, we may suspend or terminate access to premium features until payment is successfully processed.

For subscriptions purchased through the Apple App Store or Google Play, billing, cancellations, and refunds may be governed by the applicable app store's rules, and AskFly may not be able to manage those transactions directly.

Refunds and Cancellations

Unless otherwise stated at the time of purchase or required by applicable law, subscription fees are non-refundable once charged; cancelling a subscription stops future renewals only; you will retain access to paid features until the end of the current billing period; and no refunds are provided for partial billing periods, unused time, or lack of usage.

AskFly may, in its sole discretion, provide credits, refunds, or promotional accommodations in specific cases, but is not obligated to do so. If AskFly terminates your paid subscription without cause before the end of your billing cycle, we may provide a prorated refund or access through the end of the paid term, as determined by us and where required by law.

Fair Use and Acceptable Use

You agree to use AskFly only for lawful, personal, and authorized purposes.

You may not: use AskFly in violation of any law or regulation; scrape, harvest, copy, or extract data at scale; use bots, crawlers, scripts, or automated tools to access the Platform without authorization; reverse engineer, decompile, exploit, interfere with, or compromise the Platform; upload malware, harmful code, malicious content, false information, unlawful material, defamatory material, obscene material, or infringing material; use AskFly to build, train, benchmark, or assist a competing product or service; resell access to AskFly, share premium access outside permitted use, or impose unreasonable load on infrastructure; or rely on AskFly for emergency, life-critical, or time-sensitive crisis situations.

We may impose usage limits, rate limits, feature restrictions, or account-level controls to protect the Platform, users, and business operations.

User Content and Submissions

You may submit content to AskFly, including questions, messages, uploaded documents, trip details, preferences, feedback, or other materials ("User Content").

You retain ownership of your User Content, but you grant AskFly a worldwide, non-exclusive, royalty-free license to host, store, use, process, reproduce, adapt, modify, display, and transmit such content as necessary to operate the Platform; provide services to you; improve features and performance; maintain safety, quality, and compliance; and enforce these Terms.

You represent and warrant that you have the right to submit the User Content; your User Content does not infringe any third-party rights; and your User Content is not unlawful, fraudulent, or misleading.

Intellectual Property Rights

AskFly and its licensors own all rights, title, and interest in the Platform, including software, design, branding, trademarks, logos, interfaces, text, graphics, compilations, databases, proprietary workflows, AI prompt structures, site content, app content, and materials.

Except for the limited right to use the Platform under these Terms, no rights are granted to you. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, republish, or exploit AskFly content except as expressly permitted by us in writing.

"AskFly," its logos, branding, and related marks may not be used without prior written consent.

Feedback

If you provide suggestions, ideas, recommendations, or feedback about AskFly ("Feedback"), you grant us a worldwide, perpetual, irrevocable, royalty-free right to use, adapt, modify, publish, and incorporate that Feedback without compensation or obligation to you.

Privacy and Data Use

Your use of AskFly is also subject to our Privacy Policy, which explains how we collect, use, store, disclose, and process personal information.

By using AskFly, you acknowledge that internet transmissions are never completely secure; no system can be guaranteed to be fully secure; and AskFly may use service providers, analytics, cloud infrastructure, payment processors, third-party APIs, AI providers, and other vendors in operating the Platform.

You agree not to submit information you do not have the legal right to share.

Communications and SMS/Email Notifications

By creating an account or using AskFly, you consent to receive transactional communications from us by email, push notification, or SMS where applicable, including account verification, login alerts, billing notices, subscription notices, trip or travel alerts, service updates, and support messages.

If you opt into marketing communications, you may also receive promotional messages. You may unsubscribe from marketing messages at any time, but you may still receive transactional communications necessary for your account or service use. Message and data rates may apply for SMS communications.

Disclaimers

ASKFLY IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASKFLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, AND ERROR-FREE OPERATION.

Without limiting the above, AskFly does not warrant that the Platform will always be available, uninterrupted, or error-free; the information provided will always be current, complete, or correct; the Platform will detect all travel issues, entry restrictions, or documentation deficiencies; any recommendation, score, checklist, or alert will prevent travel disruption or loss; or any third-party provider will perform as expected.

Travel is inherently uncertain. Regulations, border rules, airline policies, weather, strikes, operational disruptions, safety conditions, government actions, and supplier policies can change at any time. AskFly is not responsible for such changes or their consequences.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASKFLY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOST BOOKINGS, MISSED FLIGHTS, DENIED BOARDING, VISA DENIALS, MISSED CONNECTIONS, TRAVEL DELAYS, BUSINESS INTERRUPTION, OR REPUTATIONAL HARM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASKFLY'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (1) THE AMOUNT YOU PAID TO ASKFLY IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (2) CAD $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless AskFly and its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising from or related to your use or misuse of AskFly; your violation of these Terms; your User Content; your violation of any law or third-party rights; your travel decisions; your reliance on third-party services; or your disclosure of confidential AskFly information.

Suspension and Termination

We may suspend, restrict, or terminate your access to AskFly at any time, with or without notice, if you violate these Terms; misuse the Platform; we suspect fraud, abuse, or unlawful activity; required by law or security concerns; continuing to provide access creates risk to AskFly or others; or you violate confidentiality obligations applicable to beta, early access, tester, or First 100 User programs.

You may stop using AskFly at any time. If you wish to delete your account, you may do so through available account tools or by contacting support, subject to any legal or operational retention requirements.

Termination does not affect rights or obligations that by nature should survive termination, including payment obligations, intellectual property protections, confidentiality, disclaimers, limitations of liability, indemnities, and dispute resolution provisions.

Force Majeure

AskFly shall not be liable for any delay, interruption, failure, loss, or inability to provide services caused by events beyond its reasonable control, including natural disasters, severe weather, war, terrorism, civil unrest, pandemics, epidemics, government actions, regulatory changes, labor disputes, strikes, internet outages, power failures, cloud provider failures, payment processor failures, third-party API failures, cyberattacks, security incidents, or other events beyond AskFly's reasonable control.

Arbitration and Class Action Waiver

Please review this section carefully. It affects your legal rights.

To the maximum extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or your use of AskFly shall be resolved through final and binding arbitration on an individual basis, except where prohibited by law or where either party may bring a qualifying claim in small claims court.

You and AskFly agree not to bring claims as a plaintiff or class member in any purported class or representative proceeding; that arbitration will be conducted only on an individual basis; and that no arbitrator may consolidate claims of multiple users unless both parties agree.

Before initiating arbitration, both parties agree to first attempt to resolve the dispute informally by written notice.

Governing Law and Venue

These Terms shall be governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Subject to the arbitration section above, any dispute not required to be arbitrated shall be brought exclusively in the courts located in Montreal, Quebec, and you consent to those courts' jurisdiction.

Mobile App Terms

If you download or use the AskFly mobile app, you receive a limited, non-exclusive, non-transferable, revocable license to use the app for personal use only. You must comply with the terms of the applicable app store. AskFly may require updates for security, compatibility, or functionality.

Apple and Google are not responsible for the AskFly app, its content, support, maintenance, or claims related to it, except as required under their platform rules. For iOS users, Apple and its subsidiaries are third-party beneficiaries of these Terms to the extent required by Apple's app marketplace rules.

General Terms

These Terms, together with our Privacy Policy and any additional policies or plan terms presented to you, form the entire agreement between you and AskFly regarding the Platform.

If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of our rights. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, restructuring, financing, or sale of assets.

We may update these Terms from time to time. If we make material changes, we will provide notice as required by law. Your continued use of AskFly after updated Terms become effective constitutes acceptance of the revised Terms.
